1. Introduction

The Durham Company, GEC Durham Industries, Inc., and L&W Industries LLC (collectively, the “Companies,” “we,” “us,” or “our”) respect your privacy. This Privacy Policy explains what information we collect, how we use it, with whom we share it, and the choices you have. It applies to information collected through our websites (including durhamusa.com, gecdurham.com, and lwind.com), our products, and our normal business operations.

The Companies are headquartered in Lebanon, Missouri, and manufacture electrical enclosures and related products for utility and industrial customers. Because we sell primarily to businesses, most of the personal information we handle is provided to us in a business-to-business

context.

2. Information We Collect

2.1 Information You Provide to Us

We collect information you give us directly, such as when you request a quote, place an order, fill out a contact form, apply for a job, or communicate with our team. This includes business contact information like your name, job title, employer, email address, phone number, and

mailing address. When you place an order, we also collect purchase, shipping, and billing details. Payment card information is processed by our third-party payment providers and is not stored by the Companies. If you apply for employment with us, we collect the information you

submit as part of the application. We also collect any other information you choose to share.

2.2 Information Collected Automatically

When you visit our websites, our service providers and we may automatically collect device and browser information (such as your IP address, browser type, and operating system) and usage information (such as which pages you view, what you click, how long you stay, and which

website referred you). We also use cookies and similar technologies to operate the site, remember your preferences, and measure performance.

2.3 Information From Third Parties

We may receive information about you from business partners, distributors, public sources, or service providers such as marketing platforms, lead generation services, and fraud prevention tools.

3. How We Use Information

We use personal information to run the business and serve our customers. That includes providing quotes, fulfilling orders, and delivering products and services. We use it to process payments, manage accounts receivable, and communicate with you about orders, products, support, and service issues. We may send marketing communications where permitted by law, and you can opt out of those at any time. We also use information to operate, maintain, secure, and improve our websites and business systems, to comply with our legal obligations, to

enforce our agreements, and to protect the Companies, our customers, and the public.

4. How We Share Information

The Companies do not sell personal information. We share information only as needed to run the business and to meet our legal obligations.

We share information with service providers that perform functions on our behalf, such as payment processing, IT infrastructure, web hosting, marketing automation, and shipping. We share information among the Companies where doing so helps us serve you or operate the business. We share information with business partners and distributors when it is needed to fulfill an order or support a relationship you have initiated with us. We may share information with government authorities or other parties when required by law or court order, or when it is necessary to protect rights, safety, or property. If any of the Companies are involved in a merger, acquisition, financing, or sale of business assets, information may be transferred to a successor in interest as part of that transaction.

5. Cookies and Tracking Technologies

Our websites use cookies and similar technologies to function properly and to help us understand how visitors use the site. You can control cookies through your browser settings. Disabling cookies may affect site functionality.

6. Data Security

The Companies maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. These safeguards include access controls, multi-factor authentication for remote and administrative access, network monitoring, employee training, and vendor oversight. No system is perfectly secure, however, and we cannot guarantee absolute security.

7. Data Retention

We retain personal information only as long as needed for the purposes described in this Policy, to satisfy legal, tax, accounting, or reporting requirements, or to resolve disputes. Retention periods are set out in our internal Data Retention and Destruction Policy.

8. Your Choices

You can opt out of marketing emails at any time by using the unsubscribe link in the message or by contacting us at the address below. You may also contact us to request access to, correction of, or deletion of personal information we hold about you, and we will respond consistent with

applicable law. You can manage cookies through your browser.

9. Children’s Privacy

Our websites and products are intended for business users and are not directed to children under the age of 13. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.

10. State-Specific Rights

Depending on where you live, you may have additional rights regarding your personal information under state laws such as the California Consumer Privacy Act (CCPA), the Virginia Consumer Data Protection Act (VCDPA), and similar laws in other states. To exercise these rights, contact us using the information in Section 13. We will not discriminate against you for exercising your rights.

11. Data Breach Notification

If the Companies experience a security breach involving personal information, we will provide notice to affected individuals and applicable regulators consistent with Mo. Rev. Stat. § 407.1500 and other applicable laws.

12. Changes to This Policy

We may update this Privacy Policy from time to time. The “Last Reviewed” date at the top of this Policy reflects the most recent update. Material changes will be communicated through our website or other appropriate means.
